What Happens when you get behind the wheel of a car after drinking

You just got up from your table and started to make your way out of the restaurant/bar or other venue and are getting excited thinking about getting home. However, as your hand touches the edge of your keys, you realize that your head is feeling a little bit fuzzy from the couple of drinks you had with friends. You wonder to yourself, should I drive? Or should I get a cab? What are the odds you’d get caught driving? Would it really be that big of a deal if you actually ended up getting pulled over anyway? I mean, you really didn’t drink that much. There is no way you are over the legal limit.

The truth is that there are a number of high risk consequences that come along with driving while impaired. However, you won’t understand the consequences until you understand the process.

The Interview

When you are stopped by the police, the first thing to understand, unless you are just sloppy drunk, is that they most likely didn’t stop you for OWI. In most cases, they have stopped you for something else. They may suspect that you have been drinking, but it’s not the first thing they are looking for when they stop you.

The interview will start out simple. The officer will be polite and tell you why they stopped you. Most likely it will be for a minor traffic violation or a signal light out. Even if they suspect you’ve been drinking, they need a reason to pull you over. They’ll begin the interview by asking you to explain how the infraction they have pulled you over for occurred. But they aren’t really interested in hearing the answers you are providing. They are looking for subtle clues to determine whether or not you’ve been drinking. Do you smell like alcohol? Are you speaking in a clear, coherent fashion? Do your answers make sense?

If you give them enough probably cause, they will then initiate the field sobriety test. This test isn’t to determine whether or not you have been drinking, but whether or not you are impaired. You can be impaired for a number of reasons, all of which can lead to an OWI or OWI per se. During the field sobriety test, you will be asked to perform a number of simple tests to test your balance, dexterity and orientation. You do have the right to refuse to participate in the field sobriety test, but doing so will require you to have your blood drawn or your breath analyzed for the presence of alcohol.

No matter how you perform on the field sobriety test, you will be asked to submit blood or breath samples to test for the presence of alcohol. Contrary to popular belief, you do not have to test higher than the legal limit to be charged with OWI or OWI per se. This is a myth that lands many people in the slammer and facing a charge. If the officer determines that you are impaired, you can be charged, regardless of what your BAC may be, even if there is no alcohol in your system.

After your arrest, you will be booked into the local jail to await your court date. That is, unless you are able to bond out. And that’s when the real fun begins. Indiana Arrests for OWI are on the rise. Think before your drink and drive.
